FEDERAL GOVERNMENT DELAY LGPD TO MAY 2021

Last Wednesday, April 29th 2020, the Federal Government published the Provisional Measure n. 959, in an Extra Edition of the Federal Official Gazette, which postpones the General Data Protection Law (“LGPD”) effective date to May 3rd 2021.

The Provisional Measure is justified by the current pandemic situation of COVID-19 in Brazil. Accordingly with the Law n. 13.709/2019 LGPD would come into force in August this year.

Several bills of law proposing the postponement of the effective date Aof LGPD were being analyzed by the National Congress. One of them, PL n. 1,179, recently approved by the Federal Senate, proposed LGPD to come into force in January 2021, with beginning  of the application of penalties only from August 2020, but surprisingly the vacatio legis period was extended by the Executive Power to the beginning of May 2021.

It is important to highlight that the Provisional Measure must be converted into Law by the National Congress.
