On November 10, 2021, the Federal Government published Decree No. 10,854/2021 (“Decree”), which deals with the consolidation of the Infralegal Labor Regulatory Framework.

The Decree reviewed and consolidated about a thousand decrees, ordinances, and normative instructions of a labor nature, which were grouped into 15 norms, with the objective of reducing bureaucracy in procedures related to labor legislation, making it more accessible.

The Decree deals with some labor standards, institutes a permanent program to debureaucratize labor standards, addresses issues of inspection of protection standards, health and safety at work, among several other issues related to labor law.

The main topics addressed in the Decree are:

  • Permanent Program for Consolidation, Simplification and Debureaucratization of Labor Norms;
  • Electronic Labor Inspection Book – eLIT;
  • Enforcement of labor protection norms and safety and health in the workplace by Labor Inspectors;
  • Electronic PPE approval certificate;
  • Electronic record of working hours control;
  • Companies that provide services to third parties (Law 6.019/1974);
  • Temporary work;
  • 13th salary;
  • Transport voucher
  • Citizen Company Program – extension of maternity leave and paternity leave;
  • Situation of workers hired or transferred to provide services abroad,
  • Weekly paid rest period (DSR) and payment of wages on civil and religious holidays;
  • Workers’ Meal Program – PAT.

The institution of the Permanent Program for Labor Simplification and Debureaucratization intends to allow the monitoring of the infralegal norms every 2 years, so that they remain current, compiled and consolidated.

Ordinances and normative acts have also been issued regulating the provisions of the infra-legal Labor Regulatory Framework.

The Decree will come into effect on December 11, 2021, with the exception of some provisions related to the Worker’s Meal Program (articles 174, § 1, 177, and 182).
