The Federal Government published last Wednesday (04.29.2020), in an Extra Edition of the Official Gazette, Provisional Measure 959, which, among other matters, postpones the start of the General Data Protection Law (“LGPD“) to May 3, 2021.
The Provisional Measure is justified by the pandemic situation of COVID-19 in Brazil. Previously, Law No. 13,709/2019 provided that the LGPD would come into effect in August of this year.
Several bills were already in Congress that proposed postponing the start of the LGPD. One of them, PL no. 1,179, recently approved by the Federal Senate, proposed that the validity be extended until January 2021, with the application of penalties only starting in August of next year, but surprisingly the vacatio legis was extended by the Executive Branch to the month of May 2021.
It is worth pointing out that, since it is a Provisional Measure, it is necessary that the text be converted into a Law by Congress.
