As stated in Central Bank Circular nº 3,814/16, all Brazilian companies receiving foreign direct investment with a net worth or asset value greater than R$250,000,000.00 (two hundred and fifty million reais) are required to file the Economic-Financial Statement DEF – 03/31/2020 with the Central Bank of Brazil (BACEN).
The DEF is composed of information about the share capital; net worth, assets and liabilities, and the “flow accounts” calculated with respect to the first quarter of the year.
The deadline for the transmission of the DEFs is June 30, 2020, and its non-compliance within the terms of the aforementioned circular may result in the suspension of the company’s foreign investment registrations, as well as the filing of an administrative sanctioning process by BACEN, as provided by law.
